Judge Cannon indefinitely postpones classified documents case

Jack Smith initially wanted to put Donald Trump on trial for mishandling classified documents last December.

Judge Aileen Cannon scheduled the trial for May 20, 2024.

But the complexities of the case and the number of pre-trial motions led to delays.

Classified documents cases normally take around two years to go to trial for a reason.

Smith pushed for the earliest trial date possible because his only concern was interfering in the November election by securing a guilty verdict that he believed would keep Trump out of the White House.

Unlike the Democrat judges in Trump’s other show trials, Judge Cannon is a fair judge who understands the judicial system isn’t intended to operate at the beck and call of Biden and Smith’s political needs.

Judge Cannon issued an order indefinitely delaying the case due to the number of unresolved motions and said she would revisit a trial date in late July.

“[F]inalization of a trial date at this juncture — before resolution of the myriad and interconnected pre-trial and [classified evidence] issues … would be imprudent and inconsistent with the Court’s duty to fully and fairly consider the various pending pre-trial motions,” Cannon wrote.

Why Cannon delayed the case

Judge Cannon delayed the case after a bombshell admission in court by Smith that prosecutors tampered with evidence.

Smith’s prosecutors changed the order of documents that the FBI seized in the outrageous raid of Mar-a-Lago in August of 2022.

Prosecutors admitted they “took care to ensure that no documents were moved from one box to another, but it was not focused on maintaining the sequence of documents within each box.”

The court filing also admitted that the FBI used stage props for the infamous photo of classified documents laid out across the floor at Mar-a-Lago.

Investigative journalist Julie Kelly reported that the FBI added in cover sheets to enhance the perception that Trump kept dangerous secrets just lying around.

“[If] the investigative team found a document with classification markings, it removed the document, segregated it, and replaced it with a placeholder sheet. The investigative team used classified cover sheets for that purpose,” Kelly added.

Trump’s lawyers argued they couldn’t be expected to meet the current trial schedule when prosecutors are admitting to corrupting evidence in their possession.

“Defense counsel cannot reasonably be expected to specify classified information that they intend to offer at trial when the Office recently disclosed that one of the most basic premises of the criminal justice process—that the prosecution team can be trusted to maintain existing evidence—no longer applies,” the filing added.

Judge Cannon apparently agreed.

Delaying this trial to at least the end of July drives a stake through the heart of any attempt to put Trump on trial for these flimsy charges in 2024.

It’s making it clear to Biden and the Democrats that the only case where they will get a crack at a guilty verdict before November is Alvin Bragg’s show trial in Manhattan.
