New York Democrats shredded the Constitution to try and get the former President.

But the battle is just beginning over the judgment against Donald Trump in his New York civil fraud case.

And Donald Trump has this ace up his sleeve to beat New York Attorney General Letitia James.

Democrat New York Judge Arthur Engoron dropped the hammer on former President Donald Trump with a staggering $364 million penalty – which could rise to $460 million with interest – against him for the sham business fraud civil lawsuit brought by Democrat New York Attorney General Letitia James.

Engoron weaponized the justice system to try and bankrupt Trump and run his business empire out of the state.

Trump was accused of committing fraud by overvaluing his assets to obtain favorable loans, but James never presented any evidence that he victimized anyone.

The banks she claimed were victims said at the trial that they wanted to do more business with Trump.

Excessive fine by New York against Donald Trump violates the Constitution

Chris Landau – a former clerk to Supreme Court Justice Clarence Thomas – explained some of the possible moves for Trump’s legal team during an appearance on The Ingraham Angle.

Host Laura Ingraham asked about the possibility of challenging the penalty under the 8th Amendment’s protection against excessive fines.

He said that Trump using the 8th Amendment was common sense because the banks that were allegedly defrauded said they would “do business” with Trump again.

“Well Laura, there’s two different issues. One is the issue of getting a bond to take the appeal, and he’ll have to put up some cash immediately for that. Then there’s the broader issue of how do you attack this crazy fine. The 8th Amendment, as the President said, says you shall not have excessive fines. It seems pretty commonsensical to say that a fine of $350 million plus interest for a victimless crime, where the person that was allegedly defrauded – the bank – said, ‘We want to do business with this guy again’ is excessive,” Landau stated.

Supreme Court could overturn New York decision against Trump

Since the New York justice system has been weaponized against Trump, he has the opportunity to get the case before federal courts, which could give him a fair shake.

“So this is an argument under the federal Constitution so that gives him the opportunity to try and take the case all the way to the U.S. Supreme Court, if necessary,” Landau explained.

New York courts could also decide to step in to protect New York City’s reputation as the financial capital of the world.

“Hopefully, Laura, the New York state courts will be able to fix this mess,” Landau added. “I mean, New York didn’t become the financial capital of the world for nothing. The New York courts have historically been very good about making sure that business disputes get resolved fairly and appropriately – that is until Trump came along.”

Real estate developers and entrepreneurs like Shark Tank’s Kevin O’Leary reacted to the Trump judgment by announcing that they were done doing business in New York.

Donald Trump has a legal path going forward to fight the witch hunt pushed by New York Democrats.
