And Donald Trump just hit a judge with one big curveball that will upend his trial.

Obama Judge Tanya Chutkan claimed that she wanted to treat Donald Trump just like anyone else.

But Chutkan’s words just got put to the test.

Democrat prosecutor Jack Smith proposed a January 2 trial date on his sham case against Trump for contesting the 2020 election.

Starting Trump’s trial two weeks before the Iowa Caucus would keep him off the campaign trail for the contests in Iowa, New Hampshire, Nevada, and South Carolina.

This is clear election interference.

It was up to Trump’s team to respond.

Trump’s lawyers proposed a trial date of April 26, 2026, based on normal federal case timelines and procedures.

Trump’s team briefly noted that the government turned over 11.5 million pages of documents, which would dwarf both the Washington Monument and Statue of Liberty in size if they stacked one document on top of the other.

To mount a proper defense, Trump’s team needs a fair amount of time to process all these documents, which is impossible under the timeline proposed by Smith and his crew of Joe Biden prosecutors.

Trump’s lawyers wrote that “we would need to proceed at a pace of 99,762 pages per day to finish the government’s initial production by its proposed date for jury selection. That is the entirety of Tolstoy’s War and Peace, cover to cover, 78 times a day, every day, from now until jury selection.”

The filing also noted that Smith wanted to go to trial in a more rapid timeline than in a misdemeanor case involving no documents in discovery.

“In this District, ordinary order when faced with such overwhelming discovery is to set a reasonable trial schedule, commensurate with the size and scope of discovery and complexity of the legal issues. The government rejects this sensible approach. Instead, it seeks a trial calendar more rapid than most no-document misdemeanors, requesting just four months from the beginning of discovery to jury selection. The government’s objective is clear: to deny President Trump and his counsel a fair ability to prepare for trial. The Court should deny the government’s request,” Trump’s lawyers argued.

Finally, if Judge Chutkan wanted to handle Trump’s case like any other one, an April of 2026 trial date falls within the bounds of how long it normally takes a federal case of this magnitude to go to trial, which is 29 months.

“Indeed, the median time from commencement to termination for a jury-tried § 371 charges is 29.4 months—many times longer than the government’s proposed schedule. And this reflects only the median, meaning half of all such cases take more time based on individualized assessments of discovery volume, complexity, and similar concerns,” the filing added.

Jack Smith clearly wants a trial and a conviction as soon as possible so Democrats can use that against Trump in the 2024 election.

If Judge Chutkan really wants to keep politics out of the trial, then she has an opportunity to show fairness.
