But Special Counsel Jack Smith was blindsided when Donald Trump threw him this curveball.

Former President Donald Trump is going to be tried in Washington, D.C.’s “Swamp” for the criminal case brought against him for challenging the results of the 2020 election. 

District Court Judge Tanya Chutkan was appointed by former President Barack Obama and has made no bones about her hostility towards Trump. 

She compared January 6 to the 9/11 terrorist attacks and the Boston Marathon Bombings when she dismissed a request by Trump’s legal team to push back his trial date and give them more time to prepare.

With an Obama-appointed hack as the judge and a jury pool from the most Democrat city in the country, Smith is hoping that he’ll get a conviction against Trump.

Trump’s legal team is trying to get Chutkan taken off of the case by using her own words against her.

Trump’s legal team asks for recusal by January 6 judge because of her bias

Lawyers for Donald Trump asked Judge Tanya Chutkan to recuse herself from the case because of her past statements about the former President and January 6, which “disqualify” her because they show her “bias.”

“Judge Chutkan has, in connection with other cases, suggested that President Trump should be prosecuted and imprisoned,” the motion for recusal reads. “Such statements, made before this case began and without due process, are inherently disqualifying.”

The lawyers said that her public statements would “taint” the trial regardless of its outcome.

“The public will reasonably and understandably question whether Judge Chutkan arrived at all of her decisions in this matter impartially, or in fulfillment of her prior negative statements regarding President Trump,” the motion added.

Chutkan has presided over dozens of January 6 cases and is known for handing out some of the harshest sentences in those cases.

During the sentencing of Christine Priola in October of 2022, she said that January 6 was “an attempt to violently overthrow the government, the legally, lawfully, peacefully elected government by individuals who were mad that their guy lost.”

She added that Trump supporters who went into the Capitol did so because of “blind loyalty to one person who, by the way, remains free to this day.”

“The public meaning of this statement is inescapable—President Trump is free, but should not be,” Trump’s lawyers stated. “As an apparent prejudgment of guilt, these comments are disqualifying standing alone.”

The motion for recusal is a longshot, but the arguments in it could pay dividends down the line during a potential appeal.

Trump slammed Chutkan on Truth Social for her remark during the Priola sentencing.

“The following TRUTH is a quote by highly partisan Judge Tanya Chutkan, angrily sentencing a J-6er in October of 2022. She obviously wants me behind bars. VERY BIASED & UNFAIR!” Trump said.

Judge Tanya Chutkan is going to preside over a Kangaroo court against Donald Trump if she is allowed to remain on the bench.
