Special Counsel Jack Smith has been racing to try and start his criminal trials against former President Donald Trump for January 6 and the alleged classified documents case.
The federal criminal cases against Trump by the rogue Biden Justice Department have been politically motivated from the beginning.
The FBI raided Trump’s Mar-a-Lago home in August of 2022 to try and do political damage to Republicans before the Midterms.
The Biden Justice Department waited two years to charge Trump for January 6, which conveniently put the case into the middle of the 2024 election cycle.
Now Smith is trying to rob Trump of his Constitutional right to start the criminal cases because polling shows that a conviction could be the one thing that could save President Joe Biden.
Jack Smith hit with an ethics complaint for election interference
House Republican Conference Chair Elise Stefanik (R-NY) filed a formal ethics complaint against Smith and sent a letter to the Justice Department’s Office of Professional Responsibility – the watchdog office for federal prosecutors – asking for an investigation into him for interfering in the 2024 election.
“Jack Smith’s multiple attempts to rush to trial the federal January 6 case against President Trump violated long-standing, explicit Justice Department policy,” Stefanik wrote.
She pointed out that Smith’s office is continuing to file motions in the January 6 case despite it being paused for the Supreme Court to consider the question of Trump’s Presidential immunity from the charges.
“Further, Jack Smith’s repeated violations of the United States District Court for the District of Columbia’s stay of proceedings are a lawless breach of trial ethics and lawyerly conduct,” Stefanik continued. “Jack Smith’s actions brought disrepute to the Justice Department and the federal government as a whole, and he should face discipline appropriately.”
Stefanik said that Smith’s rush to trial was denying Trump’s legal team the adequate time needed to prepare a defense.
“There exist approximately thirteen million pages of discovery for President Trump to review, plus thousands of hours of camera footage. Prosecutors bringing a case of this complexity–with so many consequential and novel legal issues to sort out–would normally never seek to bring it to trial within five months,” Stefanik explained. “The only reason to push for such an early trial date was to work to get the case tried before the November election, and the Justice Department Manual clearly forbids Jack Smith from taking any action on that basis.”
Representative Matt Gaetz (R-FL) filed a similar ethics complaint with Justice Department Inspector General Michael Horowitz in March against Smith for trying to pressure the Supreme Court to rule quickly in the Presidential immunity claim.
He pointed out that the Justice Department Manual for federal prosecutors explicitly prohibits timing decisions to interfere in an election.
