Supreme Court agrees to hear Donald Trump’s Presidential immunity case

The Supreme Court dealt a massive blow to the Democrat Party’s plan to convict Donald Trump before Election Day by agreeing to hear his appeal to dismiss the charges against him relating to January 6 on Presidential immunity.

“Whether and if so to what extent does a former President enjoy Presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office,” the Court wrote in accepting the case.

The Court will hear oral arguments on April 22, and a decision will likely come down at the end of June.

That means Obama Judge Tanya Chutkan won’t be able to stage her planned Soviet-style show trial before Election Day.

Trump arguments carry the day

In their brief asking the Court to take up the case, Trump’s lawyers argued that partisan prosecutors will hound Presidents once they get out of office unless there is a well-defined doctrine of Presidential immunity.

“An absence of criminal immunity for official acts threatens the very ability of the President to function properly,” Trump’s lawyers argued. “Any decision by the President on a politically controversial question would face the threat of indictment by the opposing party after a change in administrations.”

The next Republican administration could indict Barack Obama for ordering a drone strike that murdered a 16-year-old American citizen.

Joe Biden could face human trafficking charges for smuggling illegal immigrants into America.

Trump’s lawyer also argued that a stay pausing the case would prevent the Justice Department from interfering in the election by trying the leading GOP contender in the middle of the campaign.

“Conducting a months-long criminal trial of President Trump at the height of election season will radically disrupt President Trump’s ability to campaign against President Biden — which appears to be the whole point of the special counsel’s persistent demands for expedition,” the filing stated. “The D.C. Circuit’s order thus threatens immediate irreparable injury to the First Amendment interests of President Trump and tens of millions of American voters, who are entitled to hear President Trump’s campaign message as they decide how to cast their ballots in November.”

Jack Smith confirms charges are politically motivated 

In his response to Trump’s briefing, Smith all but admitted these charges against the former President were politically motivated.

Smith argued that the Supreme Court didn’t need to take up the case because Trump was a unique threat and prosecutors wouldn’t target other Presidents. 

“That dystopian vision runs contrary to the checks and balances built into our institutions and the framework of the Constitution,” Smith claimed.

At least four Justices on the Court saw differently, and now Trump’s case is on ice for months, which is a severe blow to Democrats who saw the prospects of a jury pulled from the bluest city in America as a slam dunk to deliver a guilty verdict against him for trying to overthrow the government.
