Democrats want Justice Sonia Sotomayor to retire
The death of Supreme Court Justice Ruth Bader Ginsburg in September of 2020 allowed then-President Trump to nominate Amy Coney Barrett to replace her.
Barrett joining the High Court paved the way for Roe v. Wade to be overturned in the Dobbs decision.
There’s now a 6-3 advantage of Republican-appointed Justices on the Court.
But leftists are now worried that Trump could potentially replace another Democrat-appointed Justice in a second term.
A pressure campaign is underway to get Justice Sonia Sotomayor to retire so that Biden can appoint her replacement before the end of his first term.
According to the U.S. Marshals Service records, the 69-year-old Sotomayor – who was appointed by former President Barack Obama – is a Type 1 Diabetic who has traveled with a medic in recent years and has requested medical assistance.
Democrats want to avoid a repeat of the situation that played out with Justice Ginsburg.
Ginsburg – then 81 and a cancer survivor – resisted calls to step down in 2014, when Obama was President and Democrats had 55 seats in the Senate.
Former MSNBC host Mehdi Hasan and others in the media, left-wing activist groups, and elected Democrats have called on Sotomayor to step down.
“With Joe Biden trailing Trump in several swing states and Democrats also in danger of losing their razor-thin majority in the Senate, are we really prepared for history to repeat itself? Sotomayor will turn 70 in June,” Hasan wrote in The Guardian. “I have PTSD from 2020, I think the Democrats didn‘t learn their lessons.”
A MAGA majority coming to the Supreme Court?
U.S. Senator Sheldon Whitehouse – a member of the Senate Judiciary Committee – said that Trump replacing Sotomayor would be a disaster for Democrats.
“Run it to 7-2 and you go from a captured Court to a full MAGA Court,” Whitehouse said. “Certainly I think if Justice Ginsburg had it to do over again, she might have rethought her confidence in her own health.”
U.S. Senator Richard Blumenthal (D-CT) hinted that Sotomayor should consider what happened with Ginsburg.
“I’m very respectful of Justice Sotomayor,” Blumenthal told NBC. “I have great admiration for her, but I think she really has to weigh the competing factors. We should learn a lesson. And it’s not like there’s any mystery here about what the lesson should be. The old saying — graveyards are full of indispensable people, ourselves in this body included.”
Sotomayor has made no indication that she’s ready to step down from the Court.
Her situation is going to be one to watch as the 2024 election cycle unfolds.
